These Terms of Use ("Terms") govern your use of https://leatherpumps.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about women's pumps made of leather and of leather-look materials, including material labels, leather and imitation leather terms, heel and toe styles, sizing as makers describe it, and general care. We are not a retailer, a brand, a maker, a shoe fitter, a testing laboratory, a government agency, a medical provider, or a lawyer. We do not sell shoes or other products. The Site does not give prices, product picks, or repair instructions.

Important footwear and health notice

Shoes, including high heels, can affect balance and can contribute to falls, blisters, and foot pain. Fit varies by maker and by person. You are responsible for choosing shoes that fit you and for how and where you wear them. If you have foot pain, a foot or health condition, or trouble with balance, talk to your doctor or a podiatrist. Follow the maker's care instructions and the label on any care product. In an emergency, call 911.

General information only; no medical, professional, or legal advice

Content on the Site is for general information. It is not medical, podiatric, legal, regulatory, or professional advice, and it is not a substitute for your doctor, a podiatrist, or the maker's information. We do not say that any shoe, heel height, material, or practice is comfortable, supportive, healthy, or safe for you, or that it will prevent, relieve, or treat any condition.

Leather, imitation leather, and labels

Material terms such as "leather," "genuine leather," "full grain," "top grain," "patent leather," "suede," "bonded leather," "vegan leather," "faux leather," and "waterproof" are the maker's or retailer's descriptions, not ours. Where the Site summarizes the Federal Trade Commission's Guides for Select Leather and Imitation Leather Products (16 CFR Part 24), it is a plain summary for general information, not legal advice, and the official text controls. We do not verify any maker's claims about materials, construction, or water resistance.

Environmental claims

We do not say that any material, shoe, or maker is eco-friendly, sustainable, green, biodegradable, or better for the environment. Any environmental claim on a product is the maker's. Where the Site describes the Federal Trade Commission's Green Guides (16 CFR Part 260), it does so as the Guides state it, for general information only.

Fit, comfort, and foot health

Sizing, width, and fit vary by maker and by person. Where the Site describes sizing, it describes what makers publish. We do not say that any shoe or heel height is comfortable, supportive, or good for your feet, and nothing on the Site is a fitting or a medical recommendation. Check the maker's size chart and the retailer's return policy before you buy.

Care products and makers' instructions

Shoes and care products are made and sold by third parties under their own terms. Their care instructions, warnings, and labels control over anything on the Site. Test any care product as its label directs. We have not tested any product. We are not responsible for any third party's products, claims, instructions, or recalls.

Agencies, organizations, and sources

Government agencies named on the Site, including the Federal Trade Commission, are credited for their own guidance and definitions. They do not endorse the Site, and the Site's mention of a rule, guide, or source is not a statement that any product is approved, compliant, or accurately labeled.

The Site name

"Leather Pumps" is the name of the Site. It is not a statement that any shoe discussed or linked on the Site is made of leather, or that we sell shoes or any other product.

Brand names and trademarks

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, ANY DECISION ABOUT YOUR FEET OR HEALTH, OR THE SELECTION, FIT, CARE, OR USE OF ANY SHOE OR CARE PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
